MyCpapApp Terms of Use

1.Introduction

Welcome to MyCpapApp (the “App”) and https://mycpapapp.com(the “Site”), owned and operated by MyCpapApp LLC (“Company,” “we,” “us,” or “our”), a Georgia limited liability company with a principal mailing address at 6175 Hickory Flat Hwy, Ste 110, PMB 184, Georgia, USA. These Terms of Use (the “Terms”) govern your access to and use of the App, the Site, and any related services (collectively, the “Services”). By downloading, installing, registering, accessing, or using any portion of the Services, you (“you” or “User”) agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not access or use the Services.

2. Eligibility & Account Registration

1. Age & Capacity. You must be at least 18 years old and have the legal capacity to enter into a binding contract to use the Services.
2. Account Creation. To access certain features, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
3. Account Security. Notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to safeguard your credentials.

3. Subscription & Billing

1. Subscription Plans. We offer a recurring monthly subscription (the “Subscription”) that unlocks premium features, including access to comparative CPAP product pricing.
2. Payment. By subscribing, you authorize us (or our third-party payment processor) to charge the applicable subscription fee to your provided payment method on a recurring basis until you cancel. All fees are in U.S. dollars and are non-refundable except as required by law.
3. Auto-Renewal & Cancellation. Subscriptions automatically renew at the end of each billing cycle. You may cancel at any time through your account settings; cancellation takes effect at the next billing cycle.
4. Price Changes. We reserve the right to modify subscription pricing upon reasonable advance notice. Continued use after the new price takes effect constitutes acceptance of the new price.

4. Product Information & Third-Party Links

The Services aggregate publicly available and/or partner-provided pricing information for CPAP machines and related products (the “Products”). We do not sell or ship Products; purchases are made through third-party merchants. Prices, availability, and shipping terms are provided “as is” and may change without notice. We are not responsible for third-party content, sites, or services.

5. Medical Disclaimer

The Services are informational only. We do not provide medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before making health-related decisions. Reliance on any information provided by the Services is solely at your own risk.

6. User Conduct

You agree not to:

• Use the Services for unlawful, fraudulent, or malicious purposes;
• Scrape, copy, or harvest product data except through the normal functionality of the App or Site;
• Reverse-engineer, decompile, or disassemble any part of the Services;
• Upload viruses, malware, or other harmful code;
• Infringe, misappropriate, or violate our intellectual property or the rights of others.

7. Intellectual Property

All content, trademarks, graphics, and software comprising the Services are owned by or licensed to MyCpapApp LLC and are protected by U.S. and international intellectual-property laws. Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the Services for personal, non-commercial purposes.

8. Privacy

Our collection, use, and disclosure of personal information are governed by our Privacy Policy, which is incorporated by reference into these Terms.

9. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to us, Users, or third parties. Upon termination, your license to use the Services will cease immediately.

10. Disclaimers & Limitation of Liability

1. No Warranty. The Services are provided “as is” and “as available,” without warranties of any kind, express or implied. We do not warrant that the Services will be uninterrupted, error-free, or secure.
2. Limitation. To the fullest extent permitted by law, in no event will MyCpapApp LLC, its affiliates, or their respective officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Services.
3. Cap. Our total liability for any claim arising under these Terms will not exceed the greater of (i) the amount you paid us in the 12 months preceding the claim or (ii) USD $100.

11. Indemnification

You agree to defend, indemnify, and hold harmless MyCpapApp LLC and its affiliates from and against any claims, damages, liabilities, and expenses (including attorneys' fees) arising out of your breach of these Terms, your misuse of the Services, or your violation of any law or third-party right.

12. Governing Law & Dispute Resolution

These Terms and any dispute arising hereunder will be governed by the laws of the State of Georgia, without regard to its conflict-of-law provisions. Any dispute that cannot be resolved informally must be submitted to binding arbitration in Fulton County, Georgia, in accordance with the rules of the American Arbitration Association. Each party waives the right to a jury trial.

13. Changes to Terms

We may revise these Terms at any time. We will post the updated Terms on the Site and/or in the App and indicate the “Last updated” date. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

14. Miscellaneous

• Severability. If any provision of these Terms is held invalid, the remaining provisions will remain in full force and effect.
• Entire Agreement. These Terms constitute the entire agreement between you and us regarding the Services and supersede any prior agreements.
• No Waiver. Our failure to enforce any provision of these Terms will not be deemed a waiver of our right to do so later.
